Please read these Terms of Service ("Terms") carefully before using the UseKase AI Twin WhatsApp service ("AI Twin", "Service").

By accessing or using the AI Twin Service, you ("User", "You") agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Overview of the AI Twin Service

The AI Twin is an AI-powered conversational experience delivered through WhatsApp. It provides:

• AI-generated responses
• Prompting guidance
• Content generation
• Workflow suggestions
• Industry-agnostic learning support and insights

The AI Twin may provide messages related to legal, financial, operational, strategic, or other topics based solely on User input.
All outputs are informational only and must not be relied upon for professional decision-making.

2. Eligibility

You must:

• Be 18 years or older
• Have the legal capacity to enter into binding agreements
• Use the Service only for lawful purposes

UseKase does not knowingly allow minors to use the Service.

3. No Professional Advice

The AI Twin may generate content related to:

• Business strategy
• Legal topics
• Finance
• HR & management
• Regulatory matters
• Technical or operational workflows
• Any other domain prompted by the User

UseKase is NOT providing professional advice of any kind.
All recommendations, suggestions, analyses, or generated content:

• Are automatically generated
• May be inaccurate, incomplete, or inappropriate
• Must not be used as a substitute for qualified professional advice

UseKase is not responsible for decisions made or actions taken based on AI outputs.

4. Use at Your Own Risk

By using the AI Twin, you acknowledge and agree that:

• Outputs may contain errors or hallucinations
• AI responses may be misleading
• UseKase does not guarantee correctness, reliability, or fitness for a particular purpose
• You are solely responsible for evaluating and verifying all outputs
• You assume all risks associated with using the Service.

5. User Responsibilities

You agree not to:

• Use the Service for illegal or harmful purposes
• Send sensitive personal data, protected health information, card data, or financial account numbers
• Attempt to exploit, attack, probe, or reverse engineer the Service
• Use outputs in ways that violate the rights of others
• Misrepresent content generated by the AI as certified or professionally validated

If you use the AI Twin in regulated industries (e.g., healthcare, banking, insurance, legal services), you accept that:
UseKase provides zero compliance guarantees.

6. Data Handling and Permissions

By using the Service, you consent to UseKase:

• Collecting and processing your messages
• Storing conversation logs ("memory") for personalization
• Using your role/industry/profile information
• Using your contact details for service-related communications
• Using CRM and analytics tools to improve user experience
• Sending occasional promotional messages about new skills, capabilities, or usage limits

All data practices are governed by the UseKase Privacy Policy.

7. Intellectual Property

All Service components—including prompts, workflows, models, documentation, UX, and branding—are owned by UseKase Pte. Ltd.

Users retain rights to content they input.
UseKase grants you a limited, non-exclusive, revocable license to use AI-generated outputs for personal or business purposes, subject to these Terms.

8. Feedback

If you submit feedback, ideas, or suggestions, you grant UseKase:

• A perpetual, worldwide, royalty-free license
• To use this feedback for any purpose
• Without obligation to you

9. Third-Party Services

The AI Twin may integrate with third-party platforms, including but not limited to:

• WhatsApp
• Meta services
• LLM providers
• n8n or workflow automation tools

UseKase is not responsible for availability, performance, or behavior of third-party systems.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to:

• Accuracy
• Reliability
• Fitness for a particular purpose
• Non-infringement
• Availability or uptime guarantees

UseKase does NOT warrant that:

• Outputs will be correct
• The Service will function uninterrupted
• Data will be error-free
• Issues will be fixed

11. Limitation of Liability

To the fullest extent permitted by law:

UseKase Pte. Ltd. shall have NO LIABILITY for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the AI Twin.

This includes (but is not limited to):

• Loss of data
• Loss of revenue
• Loss of business
• Reputational harm
• Wrong decisions taken due to AI output
• Regulatory or compliance consequences

If liability cannot be fully excluded under applicable law, UseKase's total liability shall not exceed:
👉 SGD $0.00 (zero).

12. Indemnification

You agree to indemnify and hold harmless UseKase, its employees, contractors, and officers from any claims, liabilities, damages, or losses arising from:

• Your use of the Service
• Your reliance on AI outputs
• Your violation of these Terms
• Your violation of any laws or regulations

13. Termination

UseKase reserves the right to suspend or terminate your access at any time, without notice, for any reason, including misuse or non-compliance.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of Singapore.

Any dispute shall be resolved via binding arbitration in Singapore, administered by the Singapore International Arbitration Centre (SIAC), before one arbitrator.
Arbitration fees shall be shared equally.
Users waive the right to class actions or joining claims.

15. Updates to Terms

UseKase may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.
